Astrazeneca Pays More Than $34 Million To Resolve Nexium Allegations

Popular Heartburn Drugs Linked to Deadly Kidney Damage

In 2015, AstraZeneca said it would pay the U.S. government $7.9 million to resolve kickback allegations involving Nexium. The government claimed AstraZeneca worked with another company to boost sales.

Hidden financial agreements between drug manufacturers and pharmacy benefit managers can improperly influence which drugs are available to patients and the price paid for drugs, Joyce R. Branda, the Acting Assistant Attorney General, said at the time.

The federal government alleged AstraZeneca agreed to pay pharmacy-benefit manager Medco Health Solutions in exchange for Medco maintaining Nexiums sole and exclusive status on certain Medco lists that give details of medicines that may be prescribed. The government further alleged that AstraZeneca provided some or all of the payment to Medco through price concessions on drugs including Prilosec, Toprol XL and Plendil.

In addition to kickbacks, AstraZeneca is accused of participating in a pay-for-delay scheme, which is when a pharmaceutical company pays another drug manufacturer to hold off on selling a generic version of a particular drug.

You May Not Need A Ppi

More than half of the people who take PPIs probably do not need them. Simple heartburn can be treated with antacids or other drugs, plus diet and lifestyle changes.

You may only have heartburn every now and thensuch as after a big, spicy meal. This may be uncomfortable, but it is not serious. You can usually get relief from an antacid, like Rolaids or Tums, or an H2 blocker, such as Pepcid AC or Zantac.

Researchers Suggest Pharmaceutical Companies And Fda Should Reconsider Otc Availability Due To Inappropriate Use Of Nexium As Well As Prilosec And Prevacid

A team of medical researchers recently examined the so-called “mechanism of injury” for the long-term use of Nexium — and perhaps other heartburn or reflux medications in the proton pump inhibitor class of drugs — apparently causing an increased risk of kidney problems as well as heart attacks and dementia.

As background, there is a growing body of medical evidence which indicates that some popular heartburn drugs and acid reflux medicines like Prevacid, Prilosec, and Nexium can cause some serious kidney-related side effects. In more detail, the use of these proton pump inhibitors for even just a couple of weeks can result in an increased risk of developing:

  • Acute Interstitial Nephritis
  • Kidney / Renal Failure
  • Acute Kidney Injury

Further, there is at least one medical study which shows the correlation between a longer time period of Prevacid, Prilosec, and Nexium use, and an increased risk of developing these serious kidney or renal conditions.

As for this recent medical research report, “Proton Pump Inhibitors Accelerate Endothelial Senescence“, it was published online as a Brief UltraRapid Communication by the Circulation Research medical journal during May 2016.

Nexium & Prilosec Recalls & Warnings

3 Deadly Nexium Mistakes

As of this time, there has not been a recall of Nexium or Prilosec related to kidney damage. However, the investigation into these drugs, from a legal standpoint, are still at the early stages. It often takes many years tens of thousands of hours of attorney time and the expense of many millions of dollars before all the facts come out that will lead to a recall.

When Should You Consider A Ppi

Talk to your doctor if you have symptoms such as trouble swallowing, weight loss, or chest pain. Call the doctor if you dont get better in about two weeks. The doctor will look for signs of problems such as GERD .

If you have GERD, you probably need a PPI. Talk to your doctor if:

  • You have heartburn at least twice a week for several weeks.
  • Food or acid often come back up into your throat.
  • You take antacid or H2 blockers, and you make changes like the ones described on this page, but your heartburn does not go away.

If your doctor thinks you need a PPI:

  • Ask to start with a low dose of generic prescription lansoprazole or omeprazole. You can also get these medicines over the counter.
  • If the heartburn gets better after a few weeks, talk to your doctor about gradually lowering your dose.

Class Action Lawsuits & Settlements

Depending on the circumstances of your personal injury case, you may be eligible to participate in a class action lawsuit or file your own individual action. Class action lawsuits serve large groups of people with the same legal issue and they may serve people from multiple geographic regions. It may be more costly to pursue justice on an individual basis. The settlements for class action lawsuits generally are very high, up to many millions of dollars in some cases. So far, some PPI lawsuits have settled for large amounts, including $20 million and $55 million dollars. See also Nexium Recall Lawsuit for Kidney Failure or Damage

How Do Ppis Treat Heartburn

Proton Pump Inhibitors work by shutting down the pumps that secrete stomach acid. Stomach acid is crucial in the digestion of food. However, too much of it is harmful to other organs in the digestive system. So when the stomach walls produce too much acid, PPIs block the enzyme that triggers its production.

When the PPIs shut down the acid production, the signs of gastroesophageal reflux disease, acid reflux, heartburn, or ulcers are reduced.

The effectiveness of PPIs is fast, and some people may tend to stop the dosage. The discontinuation of the medication may lead to a resurgence of acid production in more significant quantities.

PPIs do not treat the cause of the excessive production of stomach acid. They only block its production. Therefore, the condition may keep coming back.

The long-term use may lead to severe side effects mostly affecting the functioning of the kidney.

Outcome Variable: Ckd Stage Evolution

In this study only patients with confirmed diagnosis of CKD were included, patients with acute kidney injury and other renal diseases were not evaluated.

The evaluation of CKD stage and the identification of omeprazole users and non-users occurred at the time of diagnosis in the ambulatory clinic, followed by subsequent consultations. For a large number of patients, the CKD stage was available and recorded by the prescriber in the medical record at the time of the consultation. When the CKD stage was not available, the eGFR was calculated and classified according to the KDIGO and MS guidelines using the CKD-EPI equation without correction for race . Evolution of CKD was considered when the stage changed to a more advanced stage of renal impairment between one consultation to another, considering an increasing scale of severity starting from stage 1. In addition to this analysis, for each time, a 25% or more reduction in eGFR compared to the eGFR of the previous time was evaluated. Plus, a rapid progression analysis was performed as recommended by KDIGO .

Nexium And Chronic Kidney/renal Disease Lawsuits

Conversely, chronic kidney failure is not curable. Individuals diagnosed with chronic renal disease may find that treatment is helpful, but the disease is lifelong. Medication is a treatment option for chronic kidney failure, and in later stages, individuals may require dialysis or a transplant.

Unfortunately, individuals with chronic kidney disease may never show signs or symptoms. If symptoms do appear, they are typically not specific to the disease. Its only diagnosed with lab tests.

If youve taken Nexium for at least 2 weeks and have been diagnosed with chronic kidney/renal disease, a lawsuit for your Nexium-related injuries may be possible.

    Omeprazole Side Effects Kidney Disease

The U.S. Food and Drug Administration has cautioned against using PPIs to treat simple digestive problems like heartburn, but that is a major reason people take this drug. The drug, however, was not designed to provide quick relief it is meant for longer term use for chronic problems. With that long term usage, chances for developing adverse side effects increases. According to the American Society of Nephrology, over 20 million Americans suffer from chronic kidney disease today. Researches also have found that a quarter of kidney patients had used a PPI drug and that they then had twice the risk of dying prematurely. Another study of 10,000 adults found that PPI users were 50 percent more likely to develop chronic kidney disease than persons who did not take PPI drugs. This finding was not evident for persons who took a different class of drugs to suppress stomach acid, such as Tagamet or Zantac.

    Study Design And Population

This is a retrospective cohort study developed at the nephrology ambulatory sector of the Municipal Polyclinic of Divinópolis-MG, Brazil, from March 2017 to March 2019, following the STROBE checklist for observational research. Eligibility criteria were defined as all adult and elderly patients of both genders with established CKD diagnosis who were already undergoing clinical follow-up or who were diagnosed after insertion in the nephrology ambulatory clinic in the years 2016 and 2017. During this period, 241 patients were attended. Of these, 42 patients were excluded due to lack of confirmation of CKD diagnosis , absent creatinine values and history of neoplasms . Patients without baseline creatinine values were excluded from the study because it would not be possible to determine the estimated glomerular filtration rate and thus the baseline CKD stage. Similarly, those patients who had not recorded serum creatinine values at subsequent times were also excluded. Patients who underwent previous kidney transplantation and/or patients on renal replacement therapy, and patients who had missing data related to some of the variables used during the two-year follow-up were not included in this study. Thus, a total of 199 patients with CKD eligible for the study were included.

Nexium & Prilosec Lawsuit Settlement Amounts

As of this time, there have been no large mass tort settlements involving Nexium or Prilosec and the potential link to kidney injuries. Generally, however, large groups of settlements do not occur until such time as a few lawsuits are tried before a jury, and the manufacturer is able to more thoroughly understand its financial risk.

We are one of the few law firms that have been appointed to the Plaintiff’s Executive Committee by the judge overseeing all of the federal lawsuits involving Nexium and Prilosec, and its link to kidney and renal injuries. This means that we are directly involved in the national investigation and discovery that will hopefully result in a positive outcome for the individuals injured by this drug.

In 2016, AstraZeneca paid the United States Department of Justice a $7.9 million penalty for engaging in a kickback scheme involving the sale of Nexium and Prilosec.

In 2015, AstraZeneca settled a national class action involving deceptive marketing of Nexium for the sum of $20 million.

In 2003, AstraZeneca faced allegations by the European Commission that the company provided false and misleading information in order to protect its patent on Losec . After a two-year investigation, the Commission ordered AstraZeneca to pay a fine of 53 million .

Kidney Disease Connected With Protonix Misuse

    ? ? ? 33 OTC Medicine : ?

Sadly, people using Protonix usually will not get a sign that their kidneys are not functioning correctly. The damage caused cannot be undone. People with no kidney problems will not suspect that something is going wrong until its too late.

Protonix prevents the stomach from producing the acid necessary for breaking down food and absorbing minerals, like magnesium and calcium. Evidence shows that long term mistreatment with this drug can lead to kidney deficiency.

A kidney condition called interstitial nephritis often has no symptoms at all, and if left untreated, it can lead to chronic kidney disease. This condition occurs when the kidneys become inflamed due to a lack of minerals in the body.

Furthermore, Protonix is also connected to chronic kidney disease, progressing to kidney failure. End-stage renal disease is when kidneys are no longer able to filter the blood. Unless the patient is placed on dialysis or has a kidney transplant, the result is death.
