Kidney Disease And Social Security Disability

This months column will look at how the Social Security Administration evaluates disability claims that involve people with kidney problems. In order to understand how the SSA reviews these claims it is helpful to examine how the kidneys function in the body.

One of the main function of the kidney is removing unusable waste from the blood stream. Kidneys are referred to by the term renal. The body collects waste from the blood stream in a soluble form called urea. The kidneys are a part of the urinary system which removes waste from the body to prevent the waste from building up in the body to the point that it becomes poisonous. The liver makes urea from ammonia which is created by the body by breaking down simple proteins in the bodys cells. The urea goes through the blood picking up waste products and delivers the waste to the kidneys. In the kidneys the urea is mixed with water and acids and passes into the kidney tubules as urine. The urine then passes from the kidneys into the bladder and out of the body.

The kidneys also are endocrine organs. The kidneys secrete chemicals into the blood that help regulate other body functions such as blood pressure and the production of red blood cells.

If a patient has undergone a kidney transplant he will be considered to be disabled for 12 months after the transplant and then will be reviewed under a number of clinical tests to see if he still meets the disability standard.

When One Kidney Is Removed

If you have a kidney removed because of the cancer, but the other kidney is healthy, you will not meet the listing requirements. However, if complications arise with the remaining kidney, you may be eligible for disability under the kidney and urinary listings, which discuss qualifying kidney conditions.

    Cancer And Long Term Disability

    Whether your cancer is considered a disability in the eyes of your insurance company will depend on a few things: What stage is your cancer in? How serious are your symptoms? Does your treatment have disabling side effects?

    It may be obvious to you how your cancer prevents you from working, but your insurance company will not accept a diagnosis alone as basis for benefit approval. They will want an understanding of your specific symptoms and how they impair you from performing your job duties.

    Keeping Medical Information Confidential

    With limited exceptions, an employer must keep confidential any medical information it learns about an applicant or employee. Under the following circumstances, however, an employer may disclose that an employee has cancer:

    • to supervisors and managers, if necessary to provide a reasonable accommodation or meet an employees work restrictions;
    • to first aid and safety personnel if an employee may need emergency treatment or require some other assistance at work;
    • to individuals investigating compliance with the ADA and similar state and local laws; and
    • where needed for workers compensation or insurance purposes .

    No. Telling co-workers that an employee is receiving a reasonable accommodation amounts to a disclosure that the employee has a disability. Rather than disclosing that the employee is receiving a reasonable accommodation, the employer shouldfocus on the importance of maintaining the privacy of all employees and emphasize that its policy is to refrain from discussing the work situation of any employee with co-workers. Employers may be able to avoid many of these kinds of questions bytraining all employees on the requirements of equal employment laws, including the ADA.

    Who Qualifies For Ssdi

    • People who have worked for a number of years and had enough money taken out of their paychecks for Social Security
    • Self-employed people who paid self-employment taxes
    • You must meet Social Securitys very strict definition of disability to qualify for SSDI.
    • Having a low income or financial needs do not affect whether you can get SSDI.

    If you get turned down for SSDI, reapply, and appeal if necessary. Many cases end up being approved after an appeal. The amount you get from SSDI will be based on how long you worked, and how much Social Security tax was taken from your pay. Once you apply for SSDI, the disability clock starts running. If your disability application is approved, you become eligible for Medicare after 24 months.

    If you qualify and start getting SSDI, your spouse and any eligible children can also apply for SSDI. If you find you dont qualify for SSDI, but you are low-income and disabled, look into Supplemental Security Income . This program also can pay benefits to the disabled, but is based on your income and need.

    If you have certain serious illnesses, including some types of cancer, it may take less time to be approved. The Social Security Administration can speed up their review of disability applications for people who have a diagnosis thats on their Compassionate Allowances list.

    Evidence Required If You Qualify Pursuant To Section 600

    The Social Security Administration requires the following evidence to determine whether a person qualifies for disability benefits pursuant to Section 6.00:

    • Reports from clinical examinations
    • Treatment records, including information about your response to treatment
    • Lab findings, such as serum creatinine or serum albumin levels
    • Estimated glomerular filtration rate . This is an estimate of; your kidneys filtering capacity.
    • Kidney or bone biopsy. If you have had a kidney or bone biopsy done,;a copy of the pathology report or a statement from your doctor should be submitted with your disability application.

    Generally, evidence is needed for a period that covers at least 90 days.

    Disability, for the purposes of work accommodation, can be the consequence of a disease, injury or condition that impairs ones ability to perform their normal functions in life and work. It can include those who have, or are perceived to have, a mental or physical disability, whether visible or non- visible, with some degree of permanence. For example, this does not include a brief event such as a headache but could include cognitive impairment related to a head trauma which interferes with concentration and productivity.

    If Youre Not Sure If Your Impairment Is Substantial Or Long Term

    Get advice from your doctor or other medical professional. You could ask them to tell you:

    • how long your impairment is likely to last and whether its likely to get worse
    • what would happen if you stopped your medication or other treatment
    • if there are any activities you should avoid

    You doctor might also be able to help you prove you have a disability if you need to later on.

    You can also try keeping a diary for a while – write down what you do, what you find difficult and why. This might make it clearer how much your impairment is affecting your normal day-to-day activities. Your friends and family might also be able to help you think of ways youre affected.

    Monitoring And Controlling Your Blood Pressure

    High blood pressure can damage blood vessels in your solitary kidney. If your kidneys blood vessels are damaged, they may no longer work properly.     Applying For Social Security Disability With Kidney Disease

    If you are applying for SSDI benefits, you can apply online on the SSA website, by phone at 1-800-772-1213, or at your local Social Security office. If you are applying for SSI benefits, you may start the application online, but must complete the application in person at an SSA office. The SSA has an office locator to help you find your nearest office. There are at least four SSA offices in every state.

    Maintaining detailed records that illustrate the severity of your kidney disease will increase your chances of getting approved for benefits. The SSA will need copies of all of your lab reports, test results, treatment summaries and outcomes, and descriptions of surgeries. You may also have to have an estimated glomerular filtration rate test and a kidney or bone biopsy. Each doctor who treats you should provide a note that describes your condition, your symptoms and your limitations.

    If your initial claim is denied, you may appeal the decision online or at your local SSA office, or even in court. Most denials result from lack of medical evidence or a technical error while applying. Take your time carefully completing your initial application to improve your chances for a speedy approval.

    If;the therapy requires a regular dosage of a;medication that needs to be adjusted daily, the time spent on activities directly related to determining the dosage and administering the medication can be;counted in;the 14 hours per week requirement. For example, time spent on the following activities for insulin therapy:

    • checking blood glucose levels
    • preparing and administering the insulin
    • calibrating necessary equipment
    • testing ketones
    • keeping a log book of blood glucose levels

    If a child cannot;do the activities related to the therapy because of their age, the time spent by the childs primary caregivers to do and supervise these activities can be counted;in the 14 hours per week requirement.
